The role of constitutional texts in combating intellectual extremism leading to terrorism

Abstract

The study examines constitutional legal texts addressing the threat of extremism, which society deprives of its ability to attain. The study also identifies intellectual extremism as the adoption of official accounting ideas for human customs and values. These ideas include justifying violence, or both, through training and hatred, which could in the future include terrorist ideas and other forms of ideology. The study reviews the constitutional and legal framework, which in turn determines the legal basis for not accepting intellectual extremism. This is achieved by balancing freedom of expression, on the one hand, and extremist ideas, which pose various risks to peace and public security. It aims to address the role of constitutional texts in confronting extremism, as constitutions establish a set of principles to protect public order, such as freedom of expression, provided that this freedom is within the limits set by the law, ensuring that it does not harm the security of society or the security of the state. It also includes matters related to combating extremism, such as anti-terrorism laws, which monitor the dissemination of extremist ideas or participation in terrorist organizations. The challenges discussed in the research lie in the intersection of individual rights and public security. The application of constitutional and legal provisions can lead to individuals' freedom to express their opinions, as guaranteed by the constitution. The research also highlights the role of educational, religious, and legal institutions, as well as the role of the media and the judiciary in combating intellectual extremism. It also highlights the role of institutions in spreading intellectual and moral awareness among individuals.
