The development of technology and the spread of online contracting have made electronic contracts important in legal transactions. In this context, the judge's
discretionary power has emerged in accepting or rejecting electronic agreements based on the availability of legal standards, regardless of the availability of genuine consent, the validity of the expression of will electronically, the availability of the elements of the contract, and the absence of disruption of public order, fraud, or exploitation. The judge exercises his discretionary power in electronic contracts by verifying the parties' identities and the means of proof.
